Legal Issues and Challenges in the Cosmetics Industry
Litigation and Dispute Resolution Attorney Charles Weiss published an article on various legal issues that arise within the cosmetic industry. Identifying the term “cosmetics” in a legal stand point is quite tricky. The U.S. Federal Food, Drug and Cosmetic Act (FD&C Act) that is administrated by U.S. Food & Drug Administration (FDA) created a very broad definition concerning cosmetics. This has resulted in professionals questioning if their products are cosmetic or drugs. Mr. Weiss states majority of court cases formed under cosmetics revolve under the labels and advertisements representing the product, patents, trade secrets within the cosmetic industry and packaging of the products.
