Real Estate Attorneys Jerald Cohn and Amy Klug authored a Lexis Practice Advisor Note for Lexis Nexis explaining the commercial foreclosure process in the District of Columbia. The vast majority of commercial foreclosures in the District of Columbia are nonjudicial. Accordingly, while judicial commercial foreclosures can occur in the District of Columbia, they are exceedingly rare, and this practice note focuses on the more prevalent practice of nonjudicial foreclosure. Residential foreclosures in the District of Columbia are handled differently than commercial foreclosures and this practice note excludes residential foreclosures.
