DOL Drops Trump Administration's Independent Contractor Rule

On May 5, 2021, the U.S. Department of Labor announced that it was officially withdrawing the final rule proposed under the Trump administration regarding the standard for determining a worker’s status as an independent contractor under the Fair Labor Standards Act.  The proposed final rule was intended to give guidance on the test applied by the DOL and courts for determining independent-contractor status.  It is not clear whether the DOL intends to replace the guidance that would have been offered by the proposed final rule.
