Florida Litigation Reforms Target Damage Windfalls for Plaintiffs and Their Lawyers

Insurance Fraud and Recovery attorneys David Spector and James Duffy co-authored a Washington Legal Foundation article about the effects that House Bill 837, signed by Gov. Ron DeSantis in March 2023, has on Florida law. Because of House Bill 837, letter of protection shifts in Florida law in two critical ways. The first change is the required disclosure of a letter of protection as a condition precedent to asserting any claim for medical expenses in a personal injury or wrongful death suit. The second major change is to the admissibility of evidence for unpaid medical bills that are secured by a letter of protection and provide fact finders with an objective framework for determining the reasonable value of a medical provider’s charges. This change will allow defendants to explore whether the medical provider is biased toward the plaintiff.
