Mid-Year PFAS Regulatory Update
Environmental attorney Dianne Phillips authored an article for the summer 2024 edition of the Environmental Bankers Association (EBA) Journal. Ms. Phillips' article provides a mid-year update on regulations concerning per- and polyfluoroalkyl substances (PFAS). She recaps rules promulgated and proposed by the U.S. Environmental Protection (EPA) under the Resource Conservation and Recovery Act (RCRA), Safe Drinking Water Act (SDWA), Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA) and Toxic Substances Control Act (TSCA); these include new Maximum Contaminant Levels (MCLs) for six PFAS in drinking water, the designation of two PFAS compounds as hazardous substances under CERCLA and new reporting requirements for manufacturers and importers of products containing PFAS. She also reviews changes to reporting requirements for PFAS listed in the Toxic Release Inventory (TRI) as well as guidance for state environmental agencies and National Pollutant Discharge Elimination System (NPDES) permit issuers.
