Sentence T-189/25: Prior Consultation and Ethic Community Participation in Projects

Environmental attorney María Paulina Rendón published an article for Lexir examining a decision by Colombia's Constitutional Court concerning prior consultation. Through Sentence T-189/25, the court reiterated that project developers are required to guarantee the participation of ethnic communities, finding that the company overseeing the project to replace Cartagena's airport did not sufficiently guarantee the right to participation of the plaintiff, thus violating their fundamental rights. In this article, the author analyzes the context for the dispute, court's ruling and implications for future projects.
