Corporate Sustainability and Regulatory Adaptation: The Role of Minor Changes in Licensed Projects

Business Mail, AmCham Colombia
Daniela Andrea Hernandez Oviedo

Environmental attorney Daniela Hernández wrote an article for AmCham Colombia's Business Mail magazine about minor changes and their role in corporate sustainability efforts in Colombia. Minor changes consist of adjustments to licensed projects, such as incorporating new technologies, that do not require the alteration of essential elements evaluated in the process of environmental licensing – that is, they do not require a new license nor a substantial modification to the existing one before implementing. Daniela highlights that minor changes serve as an important tool for project development in the hydrocarbon, energy and mining sectors, because they allow companies to advance sustainability goals efficiently without sacrificing environmental protection. She also describes in detail what types of adjustments Colombia's National Environmental Licensing Authority (ANLA) has classified as minor changes, analyzing its pronouncements and presenting lists and charts illustrating this data. She also shares strategies for applying for a minor change, noting questions about the scope of a project and evaluation of environmental impacts that companies must answer adequately to obtain a favorable ruling.
