Supreme Court Could Upend Tribal Expectations In Tax Row

The U.S. Supreme Court could upset tribal expectations as it judges the impact of tribal authority on non-Indians in a challenge to an Eight Circuit ruling. As the court considers potentially striking down the regulation of tribal liquor and taxing authority over a Nebraska village, some say it ignores tribes’ perennial struggle with maintaining authority on their lands.

"To not talk about Indian history when you’re using equitable considerations to limit tribal rights, and suggest that these justifiable expectations were built on tribes sitting on their rights, it’s a little disingenuous,” said attorney James Meggesto.
