Immunity Concerns May Prompt Remand Of Mohegan Suit

U.S. Supreme Court justices grappled with questions surrounding tribal immunity during oral arguments about whether the driver of a Mohegan Tribe-owned limousine should face a tort suit for an off-reservation accident, suggesting the justices may send the case back to a lower court to issue a more detailed decision. Attorney James Meggesto weighed in on the case.

"They're leery of it; that rings a bell for them," said Mr. Meggesto. "There are obviously three or four justices that are deeply troubled by the doctrine of sovereign immunity and would do away with it completely or at least create an exception."
