Marca Estrella de Oro (Golden Star Trademark) Was Registered in the SIC Despite the Opposition of Saltín Noel

Intellectual Property Partner Danilo Romero Raad was interviewed for an Asuntos Legales article about the Golden Star trademark. The mark identifies products such as rice, flour and pasta with a chef and a yellow star. The company Galletas Noel S.A.S. opposed the trademark application to defend its own Saltín Noel mark, which also has a yellow star. However, the Ministry of Industry and Commerce declared the opposition unfounded and conceded the trademark to Golden Star. Mr. Romero Raad explained why, despite the similarities between the marks, the trademark was able to be registered.

"The fact that there are many trademarks that contain the expression gold does not necessarily make a new one unregistrable," he explained.
