NJ Ethics Panel Gives Attys Path To Respond To Online Critics

Legal Profession Team Co-Chair Trisha Rich was interviewed for a Law360 article about how lawyers can respond to online negative reviews. The New Jersey Advisory Committee on Professional Ethics recently issued an opinion stating that attorneys can reply to these reviews, but they do not fall within the safe harbor rule, meaning attorneys cannot reveal confidential information in their replies. Ms. Rich explained that the opinion is consistent with existing law.

"This opinion is completely consistent with the law as it developed on this issue," she said. "...Not so much anymore, but when this first started happening, people were [saying], 'This isn't true, here are the facts of what really happened.' People learned some tough lessons at the beginning."
