New Fla. Trade Secrets Law Seen as Too Easy to Abuse
Litigation Partner William Shepherd spoke with Law360 about a new Florida trade secrets law that targets foreign governments and their agents. The law enhances criminal penalties for trade secret theft by adding a second-degree felony for trafficking in stolen trade secrets, and it requires courts to order restitution for any violations. Mr. Shepherd said the new law gives attorneys more tools to prosecute trade secret theft and makes it easier for them to prove restitution losses for victims.
"I hope what it does is it raises the visibility of the importance of intellectual property crimes, and that we realize it has a broader spectrum than just the theft of the secret formula for Coca-Cola," he remarked.
