Girardi Saga Shows Why Calif. Attys Don't 'Snitch'

Trisha Rich, co-chair of Holland & Knight's Legal Profession Team, was quoted in a Law360 article about the Himmel Rule and the responsibility that lawyers have to report misconduct by other members of the legal profession. In re Himmel, was a landmark 1988 Illinois Supreme Court case that upheld the suspension of an attorney's license for failing to report misconduct by another attorney. Ms. Rich commented that most lawyers seem to have a poor understanding of the Himmel Rule.

"I think it's fair to say that lawyers get it wrong on both ends," she said. "They don't report behavior that they probably should, and they do report behavior, thinking they have an obligation to do so, that they don't actually have."
