New California Housing Lawsuits Face Major Obstacles, Attorney Says
West Coast Land Use and Environment attorney Daniel Golub was profiled by The Orange County Register about a number of recent challenges to California's ability to enforce housing laws in charter cities. Mr. Golub outlined key case law indicating why charter cities are subject to state housing laws and why they cannot ignore said laws. Based on those past rulings, he provided insight on how courts may rule in more recently filed charter city cases.
"Given the nearly 40 years of apparently unbroken authority holding that charter cities are not exempt from complying with state housing law, I expect such challenges to face substantial obstacles," he said.
