What Is a Management and Trust Employee? Cases in Which This Type of Contract Applies

Labor, Employment and Benefits attorney Camilo Cuervo was interviewed by Caracol Radio about the characteristics and applications of management, trust and direction employee contracts in Colombia. Mr. Cuervo explained that, although there is no specific legal definition for these terms in the Substantive Labor Code, case law provides guidance on these categories. He highlighted that these employees are characterized by having responsibilities that affect the company's management and administration, such as handling resources without prior authorization, making decisions that commit the company and supervising personnel. Additionally, he pointed out that their condition implies particularities in terms of working hours and rights to surcharges.
More than a type of contract, being a management, trust or direction employee is a condition based on the worker's responsibilities and functions, he said. He added that this condition can be applied in any activity, although it is more common among managers.
