What Happens to Your Bonus If You Resign or Are Fired Before the Benefit Is Paid?
Labor, Employment and Benefits attorney Camilo Cuervo was interviewed by La República about the consequences of failing to comply with labor regulations related to employee bonuses, noting that such failures can lead to sanctions from Colombia's Ministry of Labor. He highlighted that continued non-compliance might result in claims for indirect dismissal and potential compensation for employees.
"One may be subject to sanctions by the Ministry of Labor for not complying with labor regulations. Eventually, an employee may also resign, alleging a systematic failure to meet obligations. If the non-compliance continues, the employee might be entitled to compensation, commonly known as constructive dismissal," he said.
