Bridgewood Capital Recovered Children's Clothing Trademark EPK in Colombia, After Seven Years of Dispute

Intellectual Property attorney Danilo Romero was cited in an article published by El Tiempo analyzing a recent decision from Colombia's Superintendency of Industry and Commerce (SIC) in favor of the international capital fund Bridgewood Capital. During a seven-year dispute, the firm argued that the company FINTEKXIS S.A.S., headed by Samuel Tcherassi, infringed industrial property rights with respect to the trademark EPK, and called for it to cease using and exploiting the mark EPEKA. The SIC determined that Bridgewood was the owner of the trademark EPK and EPEKA was too similar to the original mark for consumers. Mr. Romero commented on the SIC's ruling.

"The sentences issued by the SIC are the clear and absolute demonstration that the owner of the EPK trademarks in Colombia is Bridgewood Capital Inc. Without a doubt, it reminds us of the importance of not confusing a consumer and of competing in the market in a transparent and clear manner," he said.
