Bogotá Executive Partner Enrique Gómez-Pinzón was interviewed by Revista Semana about the increase of legal disputes in Colombia. The article highlighted factors such as economic instability, regulatory changes and political uncertainty that have triggered an uptick in litigation, particularly in sectors such as infrastructure, energy and technology. Mr. Gómez-Pinzón emphasized the importance of developing arbitration and mediation mechanisms to improve the judicial system.
"Arbitration centers continue to handle cases submitted to them by individuals, but those that generate immediate costs for the parties have decreased," he said. "On the contrary, social arbitration processes, which do not generate any cost for the parties and have to be carried out by those who are appointed as arbitrators free of charge, have grown, as they present a more timely solution to disputes than those that judges could provide today, given the overwhelming judicial congestion. International investment arbitrations continue to increase."
