U.S. DOJ May Soon Issue Rule on Foreign Access to Americans’ PII

Cybersecurity attorney Mark Francis was quoted in a Biometric Update article about the U.S. Department of Justice's (DOJ) upcoming final rule to implement President Biden's Executive Order (EO) 14117, which aims to prevent access to Americans' sensitive personal data by countries of concern. The article discussed the potential overlap between the DOJ's rule and the recently enacted Protecting Americans' Data from Foreign Adversaries Act (PADFA), as well as the compliance burdens that may result from the broad definitions of data broker and sensitive data in the legislation. Mr. Francis highlighted the government's clear intent to protect U.S. citizens' personal data from foreign threats through these new regulations.

"This Act doubles down on restrictions intended to prevent the dissemination of sensitive personal information about U.S. residents to foreign adversaries, with broad bipartisan support," he said.
