He highlighted the significance of applying the "most favorable condition principle," a legal doctrine that mandates the application of the most beneficial rule or condition to the worker when various interpretations are possible, particularly for those nearing retirement and engaged in litigation. Mr. Cuervo stressed the importance of not abandoning ongoing legal proceedings, as it is crucial to continue these actions to ensure pension rights are protected under this advantageous principle.
"Even so, if a lawsuit has been filed, one should continue with the process, because while it is necessary to apply the most favorable condition, it is wise to maintain the lawsuit," he said.
