State Attorney General Faces Federal Courtroom Test Over Crypto Mining Ban

Law.com
International and Cross-Border Transactions attorney Robert Friedman was quoted in an article featured in Law.com about the increasing trend of state laws restricting foreign investment in U.S. real property. The article discussed a recent case in Arkansas where a crypto mining company sued the state over two laws banning ownership interest in digital mining operations by "prohibited foreign party-controlled businesses." Mr. Friedman noted that this case reflects a wider pattern emerging across the country. He also pointed out that these legislative actions, following a series of high-profile decisions from the Committee on Foreign Investment in the United States (CFIUS), are increasingly being met with legal challenges.

"We have seen dozens of state laws enacted over the last few years restricting or prohibiting investment in U.S. real property by foreign individuals, companies and governments," he said. "Arkansas is just one example of a surging national trend."
