Supreme Court Hears Suit on Retirement Plan Vendors

Litigation attorney Lindsey Camp was featured in an IGNITES article examining the Cunningham v. Cornell University case, currently before the U.S. Supreme Court, regarding the use of outside vendors in retirement plans. During oral arguments, Cornell's lawyer contended that ruling in favor of plan participants could lead to a surge in lawsuits over external vendor hiring, pressuring sponsors to settle baseless claims. Ms. Camp observed that the court's decision might be more limited than some defense attorneys hope. She also noted that justices were concerned about plaintiffs surviving dismissals merely by citing service provider contracts.

"To address these concerns, it would not be surprising if the court discusses the need to allege an injury caused by the service provider agreement to state a viable claim," Ms. Camp explained.
