Intellectual Property attorney Danilo Romero was cited in an article published by Asuntos Legales detailing protections for new varieties of flowers and plants under Colombian law. The article explained that, unlike patents, which are limited to technical inventions, plant breeders' rights offer exclusive protection for plant varieties that meet specific criteria. Mr. Romero noted securing these rights requires a formal application, emphasizing patents are not available for living plants and that specialized legal procedures are needed for plant innovators.
"It is necessary for the plant to meet a series of requirements, including assessments of novelty, distinctness, uniformity and stability," he said.
