5 Ways DOL Wage Rules Could Be Undone

Labor and employment attorney Timothy Taylor was quoted in a Law360 article discussing the U.S. Department of Labor's (DOL) ongoing efforts under the Trump Administration to unwind Biden-era wage and hour rules. Mr. Taylor clarified the wide discretion federal agencies have in deciding how to enforce regulations, noting that the DOL has announced it will no longer enforce certain independent contractor and federal contractor minimum wage rules without formally rescinding them.
"An agency always has very wide discretion, and almost unreviewable discretion, as to how it goes about enforcing the laws under its purview and the regulations that implement that enforcement," he said.
