Failure to Meet Work Goals: Grounds for Legal Dismissal?
La FM
Labor attorney Camilo Cuervo was mentioned in an article published by La FM about the legality of dismissal for failure to meet work goals in Colombia. Mr. Cuervo explained that, although a company can fire an employee for not achieving established objectives, the employee must receive a warning at least one month in advance to have the opportunity to improve their performance. He also highlighted that the comparative evaluation process with peers can take between three months and a year to ensure a fair procedure.
"To comply with this process and properly evaluate the employee’s performance, at least one month must pass between each stage, which means these procedures can take between three months and a year," he said.
