Pension Reform Faces More Than 40 Legal Challenges in the Constitutional Court

Labor and employment attorney Camilo Cuervo was cited in a La República article discussing how Colombia's pension reform is facing numerous legal challenges that cast doubt on its future and constitutionality. He explained that the Constitutional Court must now determine if the law adheres to the Constitution, cautioning that if it is deemed unconstitutional, the reform – a key government achievement – will be struck down. Mr. Cuervo also highlighted the uncertainty surrounding the process, as the court has limited time to reach a decision before the law takes effect.

"One of the lawsuits was filed by Senator Paloma Valencia; it includes a draft ruling currently under review by Magistrate Jorge Enrique Ibañez, arguing that constitutional principles were violated during the passage of the law, particularly that the necessary debate did not take place in the Chamber of Representatives," Mr. Cuervo said.
