Pension Reform in Limbo: What Will Happen to the Law and Savers?

Labor and employment attorney Camilo Cuervo was interviewed by Portafolio about the future of Colombia's pension reform after the Constitutional Court sent it back to the House of Representatives upon discovering a procedural error in its legislative process. Mr. Cuervo explained that, although the ruling does not strike down the law, the reform will remain suspended until the error is corrected. He also warned that if the House does not comply with the terms laid out by the court, one of the consequences could be the law is declared unconstitutional altogether.

"The court is giving a saving grace to the reform, but it makes clear that the democratic principles cannot be violated. [The reform] was passed via a block vote without debate, which implies an error that now should be corrected," he commented.
