The Labor Reform Is Already Law and the Night Surcharges Will Begin in 2026
Labor and employment attorney Camilo Cuervo was cited in La República commenting on Colombia's labor reform that President Gustavo Petro recently signed into law. Among the changes are that night surcharges will begin to be paid at 7 p.m. as of Jan. 1, 2026, and that overtime pay for Sundays and holidays will increase progressively until reaching 100 percent by July 1, 2027. Mr. Cuervo clarified that there will not be exceptions for these provisions in particular.
"There are no exceptions for the night surcharges. Everything who has a formal labor contract and works after 7 at night is covered by the measure," he said.
