Because of the Logo, Calvin Klein Opposed the Registration of C Bags Before the Superintendence of Industry and Commerce

Asuntos Legales
Intellectual Property attorney Danilo Romero was cited in an Asuntos Legales article about the opposition filed by Calvin Klein before Colombia's Superintendence of Industry and Commerce (SIC) against the trademark registration of C Bags. The fashion giant argued that the graphic design of the applicant's brand posed a risk of confusion with its CK brand family, which was supported by more than 20 prior registrations. The SIC concluded that, although C Bags does not explicitly contain the letter "K," the design and graphic arrangement of the mark could lead consumers to believe it was a new version of Calvin Klein's trademarks. Mr. Romero shared his opinion on the SIC's decision.

"The analysis carried out by the SIC is entirely reasonable, and it is logical to conclude that the C Bags mark is not registrable given the prior existence of the Calvin Klein CK trademark," he said.
