Trump’s Order Creates Uncertainty for Clean Energy Tax Credits
Tax attorney Nicole Elliott was quoted in a recent TaxNotes article about President Donald Trump's recent executive order (EO) related to clean energy tax credits. Following the One Big Beautiful Bill Act's repeal or phase-out of many clean energy tax credits created by the Inflation Reduction Act, the president signed an EO that could mean new or revised guidance from the U.S. Department of the Treasury about how wind and solar projects can qualify for a tax credit based on what it means to “begin construction.” Ms. Elliott said she believes the order creates ambiguity for the industry.
"The EO, in announcing there could be a change in the meaning of begin construction, a concept which is well-settled under existing IRS guidance, adds a layer of uncertainty to the wind and solar industry," she said.
