Easy Opposed But Did Not Prevail Against the Registration of Easy-Shop.com by the Superintendency

Intellectual Property attorney Danilo Romero was cited in Asuntos Legales commenting on the registration of the trademark Easy-Shop applied for by Easy-Shop.com, an e-commerce company selling various products. Cencosud S.A. opposed the trademark, arguing that the terms "shop" and ".com" are commonly used and that the Easy-Shop mark was too similar in spelling, pronunciation and concept to its own Easy trademark, thus generating confusion for consumers. Colombia's Superintendency of Industry and Commerce (SIC) concluded that both signs featured elements distinctive enough to be differentiated in the eyes of the public and allowed the registration of the Easy-Shop trademark. Mr. Romero shared his reaction to the SIC's decision.

"I disagree with the Superintendency's decision because, for me, there is a similar in terms of confusion because of potential common services offered by each brand," he said.
