Pennsylvania Legislation to Watch for the Rest of 2025

Philadelphia attorney Ken Racowski, co-head of the firm's Antitrust Team, was quoted in a Law360 article about new Pennsylvania legislation targeting algorithmic rent-setting practices. The article highlighted House Bill 140, which would bar the use of software that enables landlords to compare rent data and collaboratively set prices — a move intended to prevent artificial inflation of rents and reduced market competition. Mr. Racowski observed that legal cases regarding price-setting algorithms remain unsettled.

"Cases need to get further down the line, to look at the software and whether it's trending toward collusive behavior or competitive behavior on pricing," he said.
