Smart Fit Lost Trademark Dispute Against Fit Zone Before the Superintendency of Industry and Commerce

Intellectual Property attorney Camila López was interviewed by Asuntos Legales about the decision by Colombia's Superintendency of Industry and Commerce (SIC) that denied Smart Fit's opposition and granted registration of the Fit Zone trademark for Class 41 services. The article explained that although both marks shared the term "Fit," the SIC found sufficient differences in their additional elements and confirmed that "Fit" is commonly used in the fitness field, allowing for trademark coexistence in that class. Ms. López commented on the weight of the term's generic and widespread nature in assessing the risk of confusion.

"I consider the SIC's decision to be correct. The use of the term 'Fit' is quite widespread, not only in Class 41. It's evident that this word is widely used today," she said.
