Stem Law Positions Florida as Regenerative Medicine Hot Spot
Healthcare & Life Sciences attorney Sara Klock was quoted in the South Florida Business Journal on Florida's new stem cell law, which permits physicians to offer certain regenerative therapies outside U.S. Food and Drug Administration (FDA) approval. She explained that the statute reframes these interventions as the practice of medicine, an area the FDA does not regulate, thereby enabling providers to market treatments that would otherwise require federal clearance. Ms. Klock cautioned, however, that asserting specific therapeutic benefits could expose clinicians and clinics to scrutiny by the Florida Board of Medicine or Federal Trade Commission (FTC), elevating the risk of enforcement and private claims. She highlighted outstanding issues that regulators will have to work out as the law is implemented.
"Could a patient sue after the fact because a treatment does not do what was advertised? That's a question I have," she said.
