What You Need to Know About Pension Transfers While the Reform Is Under Review

Labor and Employment attorney Camilo Cuervo was quoted in La República commenting on the implications of the so‑called "express pension transfer" while the Constitutional Court reviews Colombia's pension reform. The article explained that this is the only provision of Law 2381 that has not been suspended and, for two years, allows individuals above the usual transfer age (52 for men and 47 for women) to move between Colpensiones and the Pension Fund Administrators (AFPs), provided they complete the required dual advisory process and meet the legal deadlines. Mr. Cuervo noted that the reform redefines how contributions are allocated between Colpensiones and private funds based on each member's income level.

"With the reform, people who earn less than 2.3 times the minimum wage automatically move to Colpensiones; if they earn more than that, they must also choose a fund," he said.
