ITAR Updates Incoming: Broker Reports, Prior Approval and Payment Disclosures

Export controls attorney Christopher Stagg was mentioned in an Export Practitioner article about the U.S. Department of State's proposal to extend two Directorate of Defense Trade Controls (DDTC) reporting requirements for brokers under the International Traffic in Arms Regulations (ITAR) Part 129 as well as ease disclosure obligations under ITAR Part 130. The Part 129 notices concern annual reports on broker activity and collecting information on U.S. and foreign persons engaging in ITAR-controlled brokering of defense services. Part 130 features disclosure requirements related to fees, commissions and political contributions, and the State Department proposes increasing the transaction reporting threshold. Mr. Stagg told The Export Practitioner the proposed amendment is years in the making and predicted active engagement in the public comment process.

"Part 130 has been one of the most widely sought areas of the ITAR for reform, so many in industry will be eager to see the proposed rule and provide comments," he said.
