Can You Be Fired for Refusing to Take the Vacation Time You Are Entitled to?
Asuntos Legales
Labor and Employment attorney Camilo Cuervo was interviewed by Asuntos Legales about the obligations of employees and employers regarding vacation time in Colombia. Camilo explained that companies not only have the authority to schedule employees' vacation time but are also required to grant it within the time frames established by law. He also noted that repeatedly refusing to take vacation as scheduled in accordance with the law could constitute a breach of an employee's obligations and, following the appropriate disciplinary process, ultimately be considered serious misconduct resulting in termination.
"If an employee refuses, they would essentially be failing to fulfill their obligations, and if they persist in refusing to comply with an employer's request, it could ultimately constitute serious misconduct, which could lead to termination of employment," he said.
