Overview
Elliott Averett is an attorney in Holland & Knight's Newport Beach office and a member of the Litigation and Dispute Resolution Practice. Mr. Averett focuses his practice on a variety of litigation matters.
Mr. Averett has experience with real estate, commercial and contract disputes, product liability matters, consumer arbitration, mass torts, class action litigation and white collar criminal defense. Mr. Averett has extensive experience briefing the admissibility of expert testimony in state and federal courts, including under the 2023 amendments to Federal Rule of Evidence 702 and California's Evidence Code.
Mr. Averett also has significant experience with appellate litigation and has appeared on brief in the U.S. Courts of Appeals for the Second, Seventh, Eighth and Ninth Circuits, as well as California's Court of Appeal and the Arkansas Court of Appeals. His victories include briefing and arguing a published opinion in the Ninth Circuit against the U.S. Department of Justice on behalf of a well-known professional athlete facing criminal charges.
Prior to joining Holland & Knight, Mr. Averett was an associate at a major international law firm in Irvine, California. Before entering private practice, he clerked for the Honorable Richard C. Tallman of the Ninth Circuit.
