Overview

Brett Elliott is a healthcare attorney in Holland & Knight's Seattle office. Ms. Elliott focuses on healthcare regulatory compliance, government enforcement defense and internal investigations.

Ms. Elliott advises clients on a broad range of healthcare regulatory matters, including compliance with fraud and abuse laws, physician self-referral (Stark), Health Insurance Portability and Accountability Act (HIPAA) and consumer health privacy and security, corporate practice of medicine (CPOM), scope-of-practice limitations and employment matters. She also works with providers to develop and strengthen compliance policies, practices and programs tailored to their operations.

Ms. Elliott's experience includes representing healthcare providers in responding to government enforcement actions, including False Claims Act (FCA) investigations and litigation, medical board and professional licensing proceedings, and state attorney general investigations. She represents healthcare providers from initial government inquiries and document requests through administrative hearings, civil litigation and negotiated resolutions.

Ms. Elliott has developed a particular focus on the medical aesthetics industry, regularly representing med spas, wellness clinics and other aesthetic providers from initial regulatory structuring and compliance program development through government investigations and enforcement defense.

Previously, Ms. Elliott was a trial attorney in the U.S. Department of Justice (DOJ) Civil Division. In that capacity, she led several healthcare investigations and litigated cases under the FCA. These matters involved alleged violations of the federal Anti-Kickback Statute, Stark Law, and Medicare and Medicaid regulations governing hospitals, skilled nursing facilities, behavioral healthcare facilities, home healthcare and other healthcare providers.

Prior to joining Holland & Knight, Ms. Elliott was an attorney at a Seattle-based law firm, where she focused on healthcare regulatory compliance, employment advice and litigation.
