Overview

Brandon Faulkner is an attorney in Holland & Knight's Tampa office and practices in the areas of general commercial and appellate litigation. He is a litigator who has represented clients in trial in state and federal courts, in arbitration proceedings, and on appeal to the Florida District Courts of Appeal and the U.S. Court of Appeals for the Eleventh Circuit.

Mr. Faulkner's recent representative matters include:

  • Representing buyers, sellers, and insurers in mergers and acquisition (M&A) disputes, including representation and warranty insurance claims, indemnification, purchase price adjustments, and post-closing covenants
  • Officer and director litigation, including matters relating to duty of care, duty of loyalty, corporate waste, fraud, self-dealing, and shareholder disputes
  • Prosecuting and defending breach of contract and business tort actions, including fraud, tortious interference, negligence, deceptive and unfair trade practices, and breach of fiduciary duties
  • Defending claims for products liability, defective design or manufacture, and failure to warn on behalf of manufacturers and retailers
  • Prosecuting and defending claims for copyright and trademark infringement, trade secret misappropriation, inventorship disputes, and patent license disputes
  • Representing lenders and banks in commercial loan litigation, including default and foreclosure actions, lender liability disputes, and Federal Deposit Insurance Corporation (FDIC) receivership claims
  • Representing taxpayers in state and local tax disputes, including before the Value Adjustment Board and in litigation

Mr. Faulkner also frequently provides pro bono assistance to clients seeking the return of children under the Hague Convention on the Civil Aspects of International Child Abduction.

Prior to his legal career, Mr. Faulkner worked as an advanced manufacturing engineer for Honeywell International, managing the production of integrated electronic guidance and navigation systems for the defense industry. As an undergraduate, he served as President of Alpha Pi Mu (the Industrial Engineering Honor Society), worked to improve public school science curriculum as a National Science Foundation Fellow, completed an honors thesis in facilities planning for an entrepreneurial biotechnology company, and received the Outstanding Graduate Award for the engineering department.
