Overview

James P. Kelly is a New York-based construction law attorney who focuses his practice on the representation of clients in litigation and transactional matters relating to the development of large-scale construction projects.

Mr. Kelly's transactional experience includes the drafting and negotiation of construction management, architecture and engineering agreements, as well as a wide variety of other contracts on behalf of owners, contractors and design professionals. Mr. Kelly also regularly represents developers and building owners in connection with adjacent property license and access agreements.

In addition, Mr. Kelly litigates a vast array of construction-related matters, including significant damage, defect and delay claims, as well as contractor and subcontractor payment and lien disputes. In addition, Mr. Kelly frequently represents clients in adjacent property access disputes, including the prosecution and defense of special proceedings seeking court-ordered access to neighboring properties.

While in law school, Mr. Kelly was a member of the Fordham Environmental Law Review and interned at Lincoln Square Legal Services – a nonprofit, professional law firm run by the school's faculty – where he assisted in the representation of low-income wage earners and small businesses in tax controversies and appeals at the federal and state level.
