Overview

Wendy Qiu is an attorney in Holland & Knight's Los Angeles office. Ms. Qiu focuses her practice on litigation, white collar investigations, privacy and consumer class action defense, and arbitration and mediation matters for local and international clients. She has experience working with clients in the banking, telecommunications, healthcare, sports, restaurant and automotive industries.

Ms. Qiu serves as lead associate and counsels clients – including crypto exchanges, media companies, credit card issuers and servicers, and other financial services companies – in federal and state litigation, mass arbitrations, class actions and individual matters involving privacy, data security, consumer protection and statutory claims. She has particular experience with claims under the California Invasion of Privacy Act (CIPA), including website wiretap claims involving automated website data collection, online tracking technologies, consent issues and alleged interception of electronic communications, as well as claims under the Telephone Consumer Protection Act (TCPA), Fair Credit Reporting Act (FCRA), Fair Debt Collection Practices Act (FDCPA), Truth in Lending Act (TILA) and Electronic Funds Transfer Act (EFTA).

In addition, Ms. Qiu helps clients evaluate, defend and resolve privacy, data security and consumer class actions through early case assessment, dispositive motion practice, mediation, settlement strategy and class settlement approval. Her matters include briefing and presenting oral argument to the U.S. Court of Appeals for the Ninth Circuit on behalf of a health and wellness business, conducting an internal investigation of a national bank relating to governance issues, and assisting in defending a financial institution in a U.S. Department of Justice (DOJ) investigation.

Prior to joining Holland & Knight, Ms. Qiu was an associate at a national firm in its Los Angeles office and a member of the complex litigation group. Her work on white collar matters included travel to China to conduct interviews, draft reports and develop a compliance program as part of an internal investigation for one of the world's largest video surveillance companies. In addition, Ms. Qiu has extensive experience in breach of contract, antitrust, fraudulent conveyance and healthcare whistleblower cases in California and New York courts.

While in law school, Ms. Qiu was a judicial extern for the Honorable Dolly M. Gee of the U.S. District Court for the Central District of California and for the Honorable Michael Linfield of the Superior Court of Los Angeles County.
