Small Business Subcontracting Plan Negotiation and Enforcement

Government Contracts attorney Amy Fuentes moderated a virtual discussion providing updates on small business subcontracting plan negotiation and enforcement. Speakers reviewed recent case law where the subcontracting plan evaluation factor significantly affected the award decision as well as legislative reforms that could address issues like creating a stand-alone subcontracting evaluation factor for solicitations requiring subcontracting plans. The session also covered challenges subcontractors face in "best in class" contracts and the negotiation and enforcement of plans.
