Litigation attorney Jessica Sievert will speak at the Federal Bar Association's annual Qui Tam Conference, a hybrid event focused on the practical side of False Claims Act (FCA) investigations and litigation. Bringing together litigators with experience on the defense, relator and government sides of FCA matters, the program will walk through U.S. Department of Justice (DOJ) priority enforcement areas, nuanced questions confronting FCA practitioners and more. Ms. Sievert's panel will explore healthcare fraud stemming from inpatient hospitalizations and emergency room (ER) services, specifically how hospital system relationships with third-party emergency room staffing companies amplify exposure under the FCA, Anti-Kickback Statute and Stark Law. She will highlight common fraud schemes such as inappropriately admitting ER patients for more lucrative inpatient hospital stays, as well as look at upcoding, high-intensity billing and ER resource usage.
