President Donald Trump issued a sweeping new executive order on March 26, 2026, requiring federal contractors to agree to new contractual prohibitions against discriminatory diversity, equity and inclusion (DEI) activities. Contractors who violate this new clause risk False Claims Act (FCA) liability, suspension or debarment, as well as contract termination.

A few weeks later on April 10, the U.S. Department of Justice (DOJ) announced that a government contractor had agreed to a $17 million payment to settle allegations that it was in violation of the FCA, due to noncompliance with anti-discrimination requirements in its federal contracts.
