When Federal And State Railroad Regulation Collide

Rail opponents have argued that the California Environmental Quality Act (CEQA) does not apply to railroad projects operated by California public entities. State laws such as CEQA are limited by federal law. The Eel River decision acknowledged that challengers may not be able to make use of all of CEQA's remedies to challenge railroad projects.
