NY Eviction Bill Raises Concerns For Residential Owners

New York Real Estate Practice Group Leader Stuart Saft wrote an article for Law360 analyzing a bill that would prevent landowners from evicting tenants, subtenants or persons without an occupancy agreement unless they could demonstrate "good cause for removal or eviction." According to the bill, which was introduced in New York's state Senate, "good causes" range from failure to pay rent to refusal to allow necessary repairs. Mr. Saft cites previous experience representing cooperative housing developments and development boards in explaining how the bill, if enacted, would damage the economic viability of residential real estate.
