DOL Letter Clarifies Compliance For Piece-Rate Pay Pacts

Labor and Employment attorneys Tina Tellado and Deisy Casto co-authored a Law360 article about the 17th opinion letter recently issued by the U.S. Department of Labor (DOL) addressing wage and hour issues. In the new opinion letter, the DOL addresses whether an employee may be paid on a piece-rate basis for all hours worked in the absence of any specific or formal agreement between the employee and employer. The letter also provides guidance regarding the nature and scope of the mutual understanding that is required for a piece-rate compensation plan under the Fair Labor Standards Act.
