What Is the Qualified Use of Trademarks?

Intellectual Property attorney Camila López published an article in Lexir about the Qualified Use of trademarks in Colombia. The country's Superintendency of Industry and Commerce (SIC) recently reiterated this concept in a decision that established the points that trademark holders should keep in mind when trying to demonstrate the use of a trademark that is not identical to the one registered. Ms. López explains the difference between the primary and secondary aspects of a trademark and recommends that trademark holders review their registration certificates to determine if the current use corresponds to the same mark or if it is necessary to apply for a new one.
