License of Use and Distinctive Signs: Intermediation in Marketing
Corporate attorney Ana Sofía Cabrales published an article in The Legal Industry Reviews about the use of distinctive signs in Colombia. Ms. Cabrales talks about how the signs directly link the producer, supplier or marketer of a product, or the provider of a service, with the consumers who purchase them. She also mentions the differences between a use license and an assignment license. Likewise, she talks about a decision of the Andean Community that prohibits the registration of signs that unduly affect a third party right. The decision has the purpose of guaranteeing the protection of the rights of the entrepreneurs' trademark registrations.
